It is our registered trademark that identifies the high quality products marketed and licensed by Nintendo of America Inc. So please use our trademark carefully. And never use it generically to describe all video game products.

source@robustjumprope It takes a while for someone to describe why in the thread, but for those curious: Trademark law is such in the US that if your product/term is the common-vernacular, you cannot enforce the trademark. i.e., no one can go to a judge with a "tooth pick" trademark.
