I presume habeas corpus petitions will be filed shortly, to find out where and on what basis ICE is detaining three US citizen Oglala Sioux.
ICE's has very limited police powers. They are restricted to immigration enforcement. They have no authority to make random stops, to detain generally, or to enter into any private space without a warrant signed by an Art. III judge.
This may sound nice on paper, though in reality ICE has shot over a dozen people and killed at least 9 in the last physical year. All of them are citizens by the way. There has been no repercussions on the ICE officers involved in the use of force incidents.

@grumble209 @clock @huntingdon Yep, that’s the thing. ”Legality” is totally out the window regarding any ICE behaviour, they just do as they please and everyone else suffers the consequences.
Legality is only relevant with enforcement behind it, and enforcement is based on human networks, it’s not some abstract thing. To quote Foucault: ”[…] the State can only operate on the basis of other, already existing power structures”.

@clock @ahltorp @huntingdon @VisualStuart It's a safe bet that if you raise a gun to ICE, they won't stop shooting until you are dead. But even if you somehow survive, you will still be arrested and you will die in custody. This is America's new reality, and it has nothing at all to do with noble laws in dusty books.
